# TERMS OF SERVICE
Welcome to the myblacksheep.pl online store. These Terms of Service outline the rules for using our store, placing orders for artisanal Black Sheep products, as well as the terms of delivery, payment, and complaint procedures.

### 1. GENERAL PROVISIONS
1. These Terms of Service are addressed to both Consumers and Entrepreneurs using the Store, unless a specific provision of these Terms of Service states otherwise.
2. Acceptance of these Terms of Service is voluntary but necessary to place an order in the Store.
3. All products offered in the Store are brand new, original, free from physical and legal defects, and have been manufactured in accordance with the cosmetic product standards applicable in the European Union.
4. Prices displayed in the Store are gross prices (inclusive of VAT) and are expressed in the currency corresponding to the region of purchase (e.g., PLN / EUR). These prices do not include delivery costs, which are specified during the ordering process.

### 2. PLACING ORDERS (CONCLUSION OF CONTRACT)
1. Orders in the Store can be placed 24 hours a day, 7 days a week, via the order form on the myblacksheep.pl website.
2. To place an order, the Customer selects the products (by adding them to the cart), fills in the contact and address details necessary for shipping, and selects the delivery method and payment method.
3. Clicking the button that finalizes the order (e.g., "Kupuję i płacę" / "Complete order") constitutes placing an order with an obligation to pay and is equivalent to concluding a distance sales contract.
4. After placing the order, the Customer receives an automated email confirming that the order has been accepted for processing in the Black Sheep laboratory.

### 3. PAYMENT METHODS AND DELIVERY
1. The Store provides modern and secure electronic payment methods (including payment cards, fast bank transfers, BLIK, Apple Pay, Google Pay) operated by certified payment providers integrated with the Shopify platform.
2. The Customer is obliged to pay for the order immediately upon placing it (in the event of a payment authorization failure, the order will be canceled).
3. Shipment of the goods takes place within the time frame specified on the product page (usually within 1–3 business days from the date the payment is credited).
4. Deliveries are made within the territory of Poland and selected European countries via specialized courier services and logistics operators (e.g., InPost, DPD, DHL). Delivery costs and estimated delivery times are clearly presented before the purchase is finalized.

### 4. RIGHT OF WITHDRAWAL (RETURNS)
1. A Consumer who has concluded a distance contract has the right to withdraw from it without giving any reason within 14 days from the date of taking possession of the goods.
2. **HYGIENIC SAFETY (VERY IMPORTANT): **Pursuant to Article 38(5) of the Act on Consumer Rights (and EU directives), the right of return **SHALL NOT APPLY** if the sealed packaging of the goods has been opened, provided that the goods cannot be returned after opening due to health protection or hygiene reasons.
3. All our cosmetics are provided with security seals. Breaking the seal or the protective foil results in the irrevocable loss of the right to return the product.
4. Detailed rules, the address, and the return form are described in a dedicated document titled Return Policy, which is available in the footer of our store.

### 5. COMPLAINTS AND CONFORMITY OF GOODS WITH THE CONTRACT
1. Black Sheep is obliged to deliver goods to the Customer that are in conformity with the contract and free from defects.
2. In the event of any non-conformity of the goods with the contract (e.g., mechanical damage to the bottle during transport, manufacturing defect), the Customer has the right to lodge a complaint.
3. Complaints must be submitted electronically to the following email address: lab@myblacksheep.pl, providing a description of the issue and – where possible – photographs documenting the defect.
4. The Store shall respond to the complaint within 14 days from the date of its receipt. In the event of a justified complaint, the product will be replaced with one free from defects, or if this is impossible, the Store will refund the equivalent of the product price to the Customer or reduce its price.

### 6. SERVICES PROVIDED BY ELECTRONIC MEANS
1. The Store provides free services by electronic means to Customers: maintaining the order form, providing a chat feature, and a newsletter subscription service (Black Sheep's Notes).
2. The newsletter service consists of sending messages containing information about new arrivals, products, blog posts, and promotions to the Customer's email address by Black Sheep. The Customer may unsubscribe from the newsletter at any time, without giving any reason, by clicking on the deactivation link included in every message.

### 7. OUT-OF-COURT DISPUTE RESOLUTION
1. The Consumer has the opportunity to make use of out-of-court complaint handling and redress mechanisms.
2. The Consumer may, among other things, request assistance from a permanent consumer arbitration court or a district (municipal) consumer ombudsman.
3. The European Union's Online Dispute Resolution platform (ODR platform) for resolving disputes between consumers and traders is available at http://ec.europa.eu/consumers/odr.

### 8. FINAL PROVISIONS
1. Sales contracts concluded through the Store shall be executed in Polish or English (depending on the selected language version of the store).
2. In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish and European law shall apply.
3. Black Sheep reserves the right to amend these Terms and Conditions for important reasons (e.g., changes in legal regulations, changes in payment or delivery methods). The new terms and conditions shall enter into force on the date of publication; however, orders placed prior to the amendment shall be governed by the version of the terms and conditions in force on the date of purchase.
